D Joiner License Agreement

1. This Licence is a legal agreement between the User (You) and D Vision Works Limited (D-VW). It permits the User, having paid a licence fee to D-VW, to use the D-Joiner software (the Software) for use by a single User on a single computer.

2. On purchase of the Licence, you receive a unique Licence number. Please keep this safe. Please do not disclose the Licence number to others. D-VW may ask for the number when you contact us.

3. By purchasing the Software, or loading the Software onto a computer or using the Software, you are agreeing to the terms of this licence.

4. If you have not bought the licence direct from D-VW or an authorised agent (listed on D-VW's web site), please contact D-VW to clarify your right to use the Software.

5. If you wish to the software on a server accessible by more than one user, or if you wish to purchase multiple user licence, please contact D-VW.

6. The copyright of the software is owned by D-VW. The Software may be protected by anti-copy technology. You agree not to attempt to copy the Software.

7. The Product Documentation referred to in this agreement means the electronic documentation describing the functionality, and operation of D Joiner. It is supplied with the product and available before purchase on request from D-VW and at the D Vision Works web site. The URL at the time of writing is www.d-vw.com/djoiner/documentation

8. The copyright of the Product Documentation and other written information supplied with the software is owned by D-VW. You agree not to copy the Product Documentation.

9. The file format for the D Joiner project file (.dst) is the property of D-VW. You may not create or modify files using this format except using software licensed to you by D-VW.

10. Warranty: The Software is warranted that it will correctly load and run as described in the Product Documentation, and on computers complying with the Hardware and Software Requirements available from DVW and at the DVW web site, for a period of 90 days from purchase of the licence from D-VW.

11. D-VW makes no representation or warranty that the Software operate in any way other than in the conditions described in the Product Documentation.

12. Product support for this product is provided by email for a period of 90 days from purchase. Please contact info@d-vw.com if you require product support.

13. D-VW's liability in the case of malfunction, or for any other reason, is limited to the purchase price paid to D-VW for the Licence

14. As User, you assume full responsibility for your use of the Software and indemnify D-VW against any claims that may result from your use.

15. D-VW makes no warranty or representation that the use of the Software will not infringe the rights of a third party.

16. You may not rent, lease, or lend the Software to others.

17. Termination: If you do not comply with this Licence agreement, D-VW may terminate the agreement with immediate effect on giving you notice. In that case you must destroy all copies of the Software, in whatever form.

18. You may not reverse engineer or otherwise disassemble the Software. If you require special interfaces to the software, please contact D-VW.

19. "D-Joiner" is a trade mark of D-Vision Works Limited.

20. This agreement does not affect your statutory rights.

21. This version of the licence agreement applies to all sales made after 28th January 2002 until further notice.

22. In the event that this agreement is different to the licence agreement supplied on the CD-ROM, the later dated version takes precedence.

23. This agreement is the whole of your agreement with D-VW with respect to your purchase of the single user D Joiner licence. Anything you have read or heard before is replaced by this.

24. English law applies to this agreement. Both you and DVW agree irrevocably and unconditionally to be bound by the exclusive jurisdiction of the English courts.
